Terms & Conditions for Tutors

Contract

Horme hereby appoints you as a part-time tutor under the Horme name, terms and conditions.

Duration

This contract shall be in effect until such time as either party notifies the other party of its termination in writing.

Nature of Contract

This contract confirms Horme’s acceptance of you as a tutor under the Horme name, terms and conditions. The contract is to perform work on a part-time basis (subject to Horme’s sourcing of suitable tutoring assignments) on instruction by Horme and subject to further acceptance by you. The contract also confirms your intention to work as a tutor for Horme as described above, on the terms and conditions as set out in this agreement.

Conduct

Horme requires that you will at all times act in an honest, polite and responsible manner for the benefit of Horme and the person(s) receiving tutoring (hereinafter referred to as “Client(s)”). You are also required to be compliant with reasonable instructions from Management. Violations of this contract will result in disciplinary action being taken. It may also result in the termination of the contract, the unilateral withholding of outstanding fees owning to you, and civil litigation if warranted. Failure to communicate with Horme over an extended period, at the discretion of management, will automatically disqualify you from continued tutoring assignments. You will not accept payment from any client on behalf of Horme for any tutoring rendered. You will indemnify Horme of any liability
resulting from personal injury, property damage or monetary loss arising out of services rendered as an Independent Contractor.

Confidentiality

Client details and communications are to be held in complete confidence. You agree that you will not at any time, during or after employment, disclose to any person (including Clients and other tutors of Horme) any information as to the practice, business dealings or affairs of Horme, its customers, suppliers or associated businesses, except in so far as is necessary and proper in the course of duty with Horme. You hereby agree, for a period of 2 (two) years after termination of this contract, to not participate in, or establish a tutoring business, other than in the capacity of a tutor. You may tutor for such a business but not be employed full-time for such a business, nor be involved in any capacity relating to the operations of such a business.

Protection of Assets

All assets such as learning aids, educational materials, equipment and tutorials belonging to Horme must be appropriately cared for and protected at all times, and may only be used for Company related business. In the event that such items are damaged or not returned, you hereby agree to replace such items or to refund Horme in full. All materials such as tutorials, examinations, logos, timetables, layouts, etc. that may be given to you during the course of your contract are the property of Horme. You are not entitled to copy, photocopy, scan, distribute or make any form of replication of them, without the prior consent of Horme.

Media

Media liaising, without the knowledge and consultation of Horme, is prohibited and in the event that you receive offers from media groups to profile your experience with Horme or provide Client information, consultation and approval from Horme is required.

Major Tutor Responsibilities

As a tutor of Horme, you hereby agree to undertake the following responsibilities:

  • To be punctual for lessons and always appear in a presentable manner.
  • To have a thorough understanding of the work that you are tutoring.
  • To confirm with a Horme representative that you have received and understand all important details regarding your client, placement and tutoring assignment.
  • To plan appropriately for all your lessons.
  • To give adequate homework examples or tutorials after every lesson.
  • To keep a record of the content covered in each lesson, test results and comments on progress – and to report back on these items to Horme on a monthly basis (in the prevailing format required by Horme).
  • To be contactable during office hours and willing to communicate regularly via e-mail and telephonically.

If you cannot make a lesson for exceptional unforeseen circumstances, to contact a Horme representative immediately.

Lessons

It is your responsibility to know the length of each lesson you are assigned (in hours or parts thereof). You hereby agree to adhere to the duration of the lessons assigned. Tutoring in excess of the stipulated time will result in you not being compensated for extra time. If the pupil wishes to cut a lesson short, then it is your responsibility to inform them, on Horme’s behalf, that the full lesson time will still be charged, for reasons which Horme can advise if required.

Time-sheets

You are required to complete a time-sheet on each Client on a monthly basis. Each Client is to have their own time sheet.

Time-sheets are to be submitted on or before the last day of each month before 21h00.

Only lessons on the time-sheet with corresponding signatures will be paid for.

  • Time-sheets may be faxed or e-mailed to the Horme office.
  • If time-sheets are e-mailed, they must be scanned or photographed with a digital camera. All text and signatures must be clearly visible on one image (page). Please use the JPEG (*.jpg) format and do not submit individual files greater than 1MB in size.
  • If time-sheets are submitted via fax or email, the originals need to be kept for a period of 3 (three) months after submission of the time-sheet. If a particular lesson is brought into dispute, you will be required to submit the original signed time-sheet. Failure to do so may result in the forfeiting of monies earned for any lessons brought into dispute.

Payment

You will earn at the standard hourly tutor rate for your region, unless otherwise stated by Horme management. Petrol is included in this rate.

You will be paid at the end of each month on condition that we duly receive the following:

  • One signed time-sheet per Client that you are tutoring, on the last day of that month.
  • The sufficient completion and submission of your monthly feedback about your Client’s progress (in the format required by the Horme).

Failure to provide either will result in late or no payment depending on the extent of the delayed period.

In the event that you pass the deadline of the end of the month for submission of your time-sheet and feedback, such payment may be delayed. Late payment will be made on or before the 8th of the following month provided that the normal payment conditions stated above have subsequently been met before the 4th of the month. If you fail to adhere to the late payment conditions, you will only be paid the following month.

This Agreement

Constitutes the entire agreement of the parties with regard to the subject matter hereof, and replaces and supersedes all other agreements or understandings. No amendment, extension, or change of the Agreement shall be binding unless in writing and signed by both parties. This agreement shall be binding upon and shall inure to the benefit of Consultant and Company and to the Company’s successors and assigns. Nothing in this Agreement shall be construed to any third party without the Company’s prior written consent.
